The Purpose behind Why Midtown Collects Data:
The Midtown Group LLC and The Midtown Group Personnel Inc. are a recruiting and staffing firm that help connect businesses and agencies with the personnel and talent to meet their requirements. We respect the privacy of both our candidates and our clients.
We interact with three kinds of individuals:
- Candidates
- Clients
- Visitors
Midtown collects data to ensure that temporary staffing services may be provided. All users of this site must be over the age of thirteen (13).
Statement of Protection of Information:
Midtown protects information that it collects by ensuring that all confidential information is kept private.
Any information collected by Midtown that goes into its service provider Bullhorn is protected. Bullhorn takes adequate security measures to protect against the loss, misuse, and unauthorized alteration of the personal data it processes.
Bullhorn also implements an advanced security method based on dynamic data and encoded session identifications, and hosts the Service in a secure server environment that uses a firewall and other advanced technology to protect against interference or access from outside intruders. Finally, Bullhorn provides individual usernames and passwords that must be entered each time a customer logs on. You are responsible for keeping your credentials safe and must contact us or our relevant customer immediately if you believe they are compromised. These safeguards help protect against unauthorized access, maintain data accuracy, and provide for the appropriate use of personal data.
Any PII data collected by Midtown is protected by encryption.
Midtown remains compliant with the following regulations:
- General Data Protection Regulation GDPR: If Midtown processes any personal dat of any EU citizens or residents, or if Midtown offers goods or services to sch people then the GDPR shall be applicable to such information. Midtown remains compliant with GDPR requirements if it comes into contact with any EU citizen data. However, most often Midtown has not encountered any EU citizen data historically.
- California Online Privacy Protection Act: If Midtown collects any data of any citizen in California, the Act is applicable. Midtown remains compliant with requirements under the Act as it has relayed its Privacy Policy to its users in a concise, transparent, and efficient manner.
- California Consumer Privacy Act: Midtown remains compliant with the requirements of this Act. Users have the following rights:
- The right to know about the personal information a business collects about them and how it is used and shared.
- The right to delete personal information collected from them (with some exceptions)
- The right to opt-out of the sale or sharing of their personal information
- The right to non-discrimination for exercising their CCPA rights.
- California Privacy Rights Act: This new law became fully operative in 2023, however, Midtown aims to be fully compliant with the new rules.
- Virginia Consumer Data Protection Act: Midtown is compliant with the requirements of this new law. If Midtown collects data from Virginia users, it shall always be compliant with the requirements of this new regulation that went into effect in January of 2023.
- Children Online Privacy Protection Act: Midtown ensures that children under the age of 13 are not to be utilizing its systems and tools. Midtown has clearly and unambiguously stated that children under the age of thirteen (13) are not supposed to be utilizing its systems and tools.
- Personal Information Protection and Electronic Documents Act: Midtown remains compliant with this regulation if it comes into contact with any Canadian users.
- Australia: The Privacy Act of 1988 requires all Australian companies to offer a privacy policy. The act regulates the handling of personal information, including data collection, usage, storage, and disclosure. Midtown remains compliant with this regulation if it comes into contact with any Australian users.
- UK: The Data Protection Act of 1988 requires any entity that collects data to offer a privacy policy. There are also rules regarding the length of time personal information should be kept, how it’s maintained, and the degree to which the data collected is relevant to its application. Midtown remains compliant with this regulation if it comes into contact with any UK users.
SMS Policy
This organization (The Midtown Group; Midtown Personnel Inc.) uses SMS messages to contact candidates and clients (job seekers and Midtown consultants). Our employees will always first gain verbal permission from candidates and clients before sending SMS messages. Also, prior to any information/data collection, Midtown Group sends a SMS message with a notification that advises the User of their rights and permissions and Midtown data/information policies.
All individuals who interact with our organization have the right to opt-out of any SMS messaging. Please contact privacy@themidtowngroup.com or +1 (202) 887-4747, if you wish to be placed on a do not call list or do not SMS list.
Our company may use automated emails and SMS messages to interact with candidates and clients. We will only send automated messages with consent and will cease all automated messaging if requested. Other SMS messages from this company will be sent through Recruiters and Business Development Representatives directly contacting candidates and clients who have already given express permission to be sent text messages.

Carriers are not liable for delayed or undelivered messages.
Privacy Policy:
For all the individuals we interact with, we make the following commitments:
- We will not share your personal information with third parties without your expressed permission.
- Your mobile number will never be shared with third parties for business purposes or promotional purposes.
- Personal information will not be shared with a third party for marketing purposes.
- We may use automatic messaging through SMS, but upon receipt of the reply “STOP” we will cease to send SMS messages to the phone number on file.
We collect personal information in the following ways:
- Submitting Requests through this site
- Job applications through third party sites
- If an individual interacts with the company through social media, we might obtain permission.
- Through discussions over phone interviews and meetings

Identifiers and Device Information:

Midtown stores some of the data that it receives in Bullhorn. Bullhorn, as provided above, does protect any information that is shared with it.

- Email Web Beacons:
Most email clients have settings which allow you to prevent the automatic downloading of images, including web beacons, which prevents the automatic connection to the web servers that host those images.
Rights and Choices
You will not receive discriminatory treatment by Midtown for the exercise of your privacy rights.

Record of Requests
We keep a record of requests that we received from California residents.
For data deletion and data access requests, our readers submit requests through our intake form. In the intake form, they mark whether they reside in California. We then send an identity verification email to the user. If the user does not verify their identity in 45 days, their request will be denied. If the user does verify in 45 days, we begin to fulfill their request.
Informing Users of Privacy Policy Changes:
Midtown will email Users of any updates related to its Privacy Policies.
